The New York State Education Department reminds Superintendents that Corporal Punishment Report forms must be submitted on July 15, 2009. The report form, which covers the six month period of January 1, 2009- June 30, 2009, is available online at http://www.emsc.nysed.gov/sss/pps/corporalpunishment/. Please complete and return the form with the original signature of the superintendent or charter school chief administrative officer to the address on the form.

6/9/09 - Proposed amendments to §§100.2(p), 120.2, 120.3 and 120.4 of the Commissioner's Regulations to conform with New York State's approval to participate in the No Child Left Behind (NCLB) Differentiated Accountability Pilot Program as granted by the United States Department of Education on January 8, 2009. Comments must be received by the State Education Department on or before August 17, 2009.

6/3/09 - The U.S. Department of Education has announced the availability of $143 million in regular 2009 appropriations and funding under the American Recovery and Rehabilitation Act of 2009 to support new awards under the Teacher Quality Partnership Grants program.

5/14/09 - Clarifying Information Regarding Confidentiality and Student Pregnancies: In response to questions we have received, clarifying information regarding confidentiality and student pregnancies is available on the Web at http://www.emsc.nysed.gov/sss/HealthServices/ .

4/21/09 - Title V-A provides no funds to LEAs beyond August 2009, however, the Title V-A program statute and the Education Department General Administrative Regulations (EDGAR) still require that LEAs maintain title to, and administrative control over, and materials and equipment acquired with program funds for the purpose of providing Title V-A services to non-public school students. 4/14/09 - Count of Immigrant Children and Youth, 2009: The Department annually collects the number of "immigrant children and youth", as defined by Section 3301(6) of NCLB, present in New York State. The data is used each year to determine each local educational agency's eligibility and allocation for the Title III, Part A Immigrant Education program. As a result, each school district and charter school must count the number of “immigrant children and youth” and report to the State Education Department by May 15, 2009.

3/20/09 - Reminder to districts: NCLB Title V, Part A was not funded in 2008-09, but any LEA funds carried over from 2007-08 are still accessible. Any Title V funds that are not expended must be returned to USDOE. To find out if you have carryover funds available, go to http://www.oms.nysed.gov/cafe/reports.html , select county, select your LEA, select '2008-09 - NCLB Allocation Report'. LEAs who have not already done so must apply for Title V carryover funds in the 2008-09 program year through an FS-10 budget, a budget narrative and page 72 of the 2008-09 consolidated application at http://www.emsc.nysed.gov/deputy/nclb/0809conapptext.html. Note that budget amendment forms (FS-10-A's) cannot be accepted as the initial application for funds.

2/3/09 - 2008-09 Differentiated Accountability Pilot Program Update - On January 8, 2009, Secretary Margaret Spellings approved New York’s participation in the United States Department of Education’s (USDE) differentiated accountability pilot. This pilot will provide New York with the opportunity to better match the interventions to improve student achievement with the academic reasons that led to the school’s identification for improvement under No Child Left Behind. In addition, this flexibility agreement allows local educational agencies (LEAs) to provide supplemental education services (SES) to eligible students in Title I schools in the first year of improvement while delaying the provision of school choice until a school has failed to make Adequate Yearly Progress subsequent to its identification for school improvement.

As required by section 9401(b)(3)(A) of the ESEA, SED is providing notice and information to the public on this flexibility agreement.
